What everyone in The Province of British Columbia, (“The Province”) who's been injured in a car accident wants to know…

HOW MUCH CAN I GET AND HOW DO I GET IT?

This pilot project includes free advice on a volunteer basis to help get you the highest settlement for your personal injury.

This is a pilot project for The Province only, (other provinces currently under review).

We have more than 30 years of collective experience investigating and settling motor vehicle accident claims, and we know "every trick in the book". In fact, we start to write the book each time we immediately arrive to initiate our comprehensive investigation. We have always worked exclusively for insurance companies to assist with the investigation, settlement, and defence of auto claims.
Although we previously conducted investigations and adjuster services for ICBC the province of our current work ("THE PROVINCE") no longer includes any service for ICBC, at all. Instead, we provide you free advice for injury claims against ICBC on a volunteer public service basis ("AGAINST ICBC").

Throughout the years we've been "on the inside", many of our friends and family have asked us for assistance about what to do when they've been injured in a car accident. We advise them how to get the highest settlement. We advise them when to get a lawyer, and when not to get a lawyer. We advise them who the best lawyer may be to help them. We advise them how to pay the least cost, or nothing at all. We advise them what not to do, to avoid losing their case. We don't charge, we aren't paid, and we don't receive any compensation for our advice.

This site is a free site and we are now passing The Province of our work and our knowledge for claims against ICBC, on to you. We just ask that you use this information for your own benefit and that when you succeed in your claim that one day you pass it forward to someone else.

Frequently Asked Questions:
1. Can I hire your firm to represent me?
Answer: No. Sorry, this service is free and on a volunteer basis and we will not represent you.

2. What does it cost me if I call or email for your advice?
Answer: Nothing. This service is free and on a volunteer basis only.

3. If I ask for your advice am I guaranteed that you will help me?
Answer: No. We do our best to help those most seriously hurt and in need and who will benefit most from our efforts. This is a free volunteer service and we will respond based upon volume of inquiries. We prioritize our response based upon how serious the injury may be.

4. I don't like lawyers, I'm worried about what they will take from me, should I bother to get one, if so whom?
Answer: You're not alone, many other people feel exactly the same way. It may be worthwhile. It depends upon where you are, what your injury is, and what needs to be done. If your claim is minor it may be better to handle things yourself, directly with ICBC. If your claim is more serious, often it would be better to have someone represent you. Send us your email and we'll tell you who we believe are the best people to help you. If your injuries are very serious and you need immediate answers then call us.

5. Are all lawyers basically the same?
Answer: Definitely Not. Think about what you do for work, and now think of the range of people who are really good and really not as good in your field. As in every field, the field of law is exactly the same.

6. Who can I call that will give me their opinion for the best lawyer for me?
Answer: (A) You can call the Law Society of British Columbia, (the governing society for all lawyers in B.C.) and they will only tell you a lawyer's area of practice and what year he/she was called to the bar. However, The Law Society of British Columbia will not provide you with an opinion of which of it's member lawyers is best for you. (B) You can call most personal injury lawyers and you may find that they all say that they are the best, or among the best, choice for you. (C) You can call us and we'll give you our independent opinion.

7. I hired a lawyer who I am really not happy with, and now I'm also getting bills. What do I do?
Answer: Sorry this is something we can't fix or respond to. All we can say is "Seek appropriate legal advice" (…yes, we know this does not always help for a person with this problem). That's why it's important to make the right choice before your hire your lawyer. Good luck!

8. What if I hire a lawyer who also works for ICBC, can he/she get me the full settlement I deserve?
Answer: These lawyers may want to represent you but what many people don't know is that these lawyers who also work for ICBC have a "strategic alliance agreement" with ICBC with ICBC not to provide certain services to you. AS only one example, those lawyers cannot represent you for claims of bad faith or punitive damages. In fact, what you may also not know is the "strategic alliance agreement" ICBC has with lawyers permits ICBC to impose penalties, on those lawyers unless they act in the best interests of ICBC. Its hard enough choosing the right lawyer to begin with but many considerations like this make it much more difficult to ever find the right lawyer.

9. Can you give me advice if I already have retained legal counsel?
Answer: No. That is what your legal counsel is for. Others who don't have legal counsel need our help more and that is where we are putting our time and resources to help out.

10. Can you give me advice if I am at fault for the accident?
Answer: No. This service is provided for people who have suffered injuries as a result of another person's negligence. If there is a question of who is at fault and your injury is serious, call us (604-618-0789) and we will try to ascertain if there is a possibility that you are not at fault.

11. How much can I get for my claim?
Answer: This is a very good question and one you should have a better idea of before deciding what to do next. If you have a lawyer, ask your lawyer. If you do not have a lawyer, and you have a:

12. An ICBC representative is calling me. Should I give any information?
Answer: Perhaps yes, if you intend to represent yourself. Perhaps no, if you do not intend on representing yourself, until you obtain advice from a lawyer.

13. I'm seriously injured, I can't afford ongoing living costs because of the accident, and I can't afford a lawyer, what should I do?
Answer: It depends upon where you are, what your injury is, and what needs to be done. Call us (604-618-0789) and we'll tell you who's the best to help you, to get you interim funding, legal representation without any payment out of your pocket, and get you the best settlement for your future.

14. If I have to go to trial to win my case, and I win, will I end up with any money after my costs?
Answer: If you get the best lawyer you have the least chance of this happening to you. For others, sometimes you can win your case …and end up owing money.

15. What should I focus on?
Answer: Getting better is what you should focus on. That means following the advice of your doctor.

16. Is there anything urgent that needs to be done.
Answer: In many cases it is essential to immediately crystallize key evidence such as witness testimony and physical evidence at the scene. This key evidence is often the difference between success and failure of your case. This key evidence also often quickly disappears. I.C.B.C. will often dispatch people to do this immediately. You should make every effort to ensure this is done immediately.

17. I, or a member of my family, have suffered a serious catastrophic injury. What do I do?
Answer: Call us and we'll make sure you find the best people to help you.

18. Can we help you with problems in connection with property damage appraisal for your motor vehicle, or coverage assessment for your motor vehicle?
Answer: No. This service is for information and advice concerning injuries, only.

19. Can we help you with problems in connection with some other area of law?
Answer: No. Our expertise and experience that we share for free only concerns personal injuries arising from automobile accidents, since we do not work with ICBC. Canada Claims Corporation continues to provide ongoing investigation, litigation management, mediation, and settlement/dispute resolution exclusively to private insurance companies and government which is not connected with this free service.
